RENTAL AGREEMENT

             It is understood that prior to departing the premises of Oregon Canoe Sport, LLC, the party renting a watercraft or other equipment shall fully inspect all such equipment. Oregon Canoe Sport, LLC shall be fully advised of any defects in the equipment. The use of said equipment will constitute an acceptance of said equipment on a rental basis “as is.” It is further understood that all use of equipment provided is at the undersigned’s own risk. The undersigned assumes all responsibility for any personal injury to himself, occupants of the watercraft, or others, and agrees to pay for any damage done to said equipment or property of others.

             I, the undersigned, am aware that the use of watercraft on any river or lake is hazardous and I assume all risks of injury, loss, and damage to persons or property during any such use, fully realizing that Oregon Canoe Sport, LLC or its agents have no control over the manner of use or the conditions of any river or lake. I agree to pay for, defend, indemnify and hold Oregon Canoe Sport, LLC, its agents, employees, successors and assignees harmless from all liabilities, claims, and demands for loss, damage or injuries to persons and property sustained by me, my heirs, children, dependents, and all other persons resulting from or in any way connected with transporting or use of the watercraft or other equipment furnished by Oregon Canoe Sport, LLC or its agents and attorney’s fees or court costs which may be incurred by Oregon Canoe Sport, LLC, its agents, or successors and assignees in enforcing any of the obligations under this agreement.

             I, the undersigned, understand and agree that no rental equipment obtained from Oregon Canoe Sport, LLC, its agents, employees, successors and assignees is to be used on whitewater under any circumstances.

             I, as a parent or guardian or supervisor of a minor child, make this agreement individually and on behalf of this minor child to induce Oregon Canoe Sport, LLC to allow the child to use or ride in a watercraft or use other equipment.
